## What “legit” should mean

A prop firm is not a scam because its accounts are simulated or because most traders fail — both are disclosed in the terms of reputable firms. ## Red flags

Each of these is a reason for caution on its own: rules that are vague about payout review or give the firm unlimited discretion; sudden changes to payout terms applied to existing accounts; heavy, permanent discounting that suggests a need for cash; payout delays blamed on “processing”; a firm name with no traceable company behind it; and promotions that promise earnings. Treat any one of them as a reason to look harder, and two as a reason to pick another firm.

## When prop firms failed

The risks are not theoretical. In 2023 the CFTC [sued the operator of My Forex Funds](https://www.cftc.gov/PressRoom/PressReleases/8771-23) and its assets were frozen, stopping trading and payouts; the case was [dismissed with prejudice in May 2025](https://www.financemagnates.com/forex/my-forex-funds-parent-defeats-cftc-in-court-as-judge-imposes-sanctions/) and the court sanctioned the CFTC.
