What “legit” should mean
A prop firm is not a scam because its accounts are simulated or because most traders fail — both are disclosed in the terms of reputable firms. FTMO, for example, states that its funded traders receive a demo account with fictitious capital. A firm is legitimate if it does what its terms say: evaluates you under the published rules and pays when you meet them.

Ten checks before you pay
Each one takes minutes, and together they filter out most problems.
- The full rulebook and terms are public before purchase, including prohibited practices and payout review.
- The company name, registration country and address are stated and match public records.
- The firm has operated long enough to have paid traders through at least one market shock.
- Traders across many accounts, not just affiliates, report receiving payouts.
- Payout rules are stable — check the rule & price changes log for recent tightening.
- Its audience is not collapsing — the firm health tracker shows the trend.
- Reviews describe denied payouts rarely, and with a rule the firm can point to — see reviews.
- Support answers a pre-sale question about a specific rule clearly and in writing.
- The platform and data provider are named and recognisable.
- Its discounts and marketing do not promise income or guaranteed funding.
Red flags
Each of these is a reason for caution on its own: rules that are vague about payout review or give the firm unlimited discretion; sudden changes to payout terms applied to existing accounts; heavy, permanent discounting that suggests a need for cash; payout delays blamed on “processing”; a firm name with no traceable company behind it; and promotions that promise earnings. Treat any one of them as a reason to look harder, and two as a reason to pick another firm.
When prop firms failed
The risks are not theoretical. In 2023 the CFTC sued the operator of My Forex Funds and its assets were frozen, stopping trading and payouts; the case was dismissed with prejudice in May 2025 and the court sanctioned the CFTC. In February 2024, when MetaQuotes withdrew its platforms from prop firms, True Forex Funds suspended operations and several firms stopped accepting US traders.
